Welcome to Fit Nesu. These Terms of Service ("Terms") govern your access to and use of the Fit Nesu application, website, and related services (collectively, the "Service") operated by Fit Nesu ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Description of Service

Fit Nesu is a fitness application that provides personalized workout routines tailored to various health conditions, fitness goals, and preferences. The Service includes:

  • Curated workout programs designed for specific health conditions and fitness objectives.
  • Exercise demonstrations with instructions and video guidance.
  • Progress tracking, streak monitoring, and achievement features.
  • Personalized workout recommendations based on your profile and preferences.
  • Saved workout collections and history.

3. Medical Disclaimer

IMPORTANT: THE SERVICE IS NOT A MEDICAL DEVICE, MEDICAL SERVICE, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

  • Always consult a qualified healthcare professional before beginning any exercise program, especially if you have a pre-existing medical condition, injury, or disability.
  • All workout recommendations, exercise suggestions, and health-related content are for general informational and educational purposes only.
  • If you experience pain, dizziness, shortness of breath, or any discomfort during exercise, stop immediately and seek medical attention.
  • We do not guarantee any specific health outcomes or results from using the Service.
  • You assume all risks associated with your use of the Service and participation in any exercises or activities suggested therein.

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Maintain the security and confidentiality of your login credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

You may not create an account on behalf of another person or use another person's account without their permission.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Upload or transmit viruses, malware, or other harmful code.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial fitness purposes, subject to these Terms.

7. User Content

You retain ownership of any content you submit through the Service (e.g., profile information, feedback). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of operating and improving the Service.

8. Subscriptions and Payments

Certain features of the Service may require a paid subscription. If applicable:

  • Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected).
  • You authorize us to charge your designated payment method for all applicable fees.
  • Subscriptions automatically renew unless canceled before the end of the current billing period.
  • Refunds are handled in accordance with applicable law and the policies of your app store or payment provider.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIT NESU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fit Nesu and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

Provisions that by their nature should survive termination (including, without limitation, intellectual property, disclaimers, limitations of liability, and indemnification) shall survive.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fit Nesu operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fit Nesu regarding the Service and supersede all prior agreements and understandings.
